Real A5 Wagyu melts in your mouth, it's absolutely a different result than marinating. You wouldn't want to eat a whole steak of that though, way too rich. You want a few ounces at most, but those few ounces are divine. If you could stomach a whole steak, it almost certainly wasn't A5.
Practically speaking you're correct, but legally speaking they favored the plaintiffs in this case, which were a collection of blue states. Like literally the states:

Eh, I only skimmed the paper but I suspect availability of alcohol skews the results. If you could just pop down to the gas station after work and pick up some crack or heroin, I suspect the relative harm would be different.

I really enjoyed going to drafts, because I enjoy the deck-building a lot. But after trying a couple local tournaments, it became apparent that people weren't actually building their own decks at all.
